The City Council to Consider Appealing Court Decision Allowing Resumption of Private Hospital Construction in Alicante

The Alicante City Council's governing team "respects" the court's decision to resume the construction of the new private hospital in Vistahermosa. This was stated by Deputy Mayor and Deputy Spokesperson Manuel Villar after learning of the ruling by the judge of Instruction No. 2 of Alicante.

Regarding the potential filing of an appeal against this ruling, Villar insisted that it is still "too early to assess," as the City Council was notified on Wednesday and the documentation is being reviewed by the municipal legal services.

The judicial resolution, accessed by TodoAlicante, overturns the Urban Planning Department's decree to completely halt the works. The company responsible for the construction of the clinical center appealed this decision, and initially, the court has ruled in its favor.

On September 13, 2024, the City Council ordered the immediate halt of the ongoing works for "not complying with the granted license," due to an increase of two floors over the permitted height and one floor over the maximum height allowed by the current planning. This is the resolution being appealed.

The ruling explains that "the execution of the appealed resolution is suspended, allowing the continuation of works that have a valid license and are not affected by the urban legality restoration procedure initiated on August 12, 2024."

In this regard, Villar emphasized that the suspension of the construction of this private hospital "should be limited to issues outside the license." That is what "we will evidently respect," he stated.

Now, following the court ruling in favor of the company, the Urban Planning Department must "verify" which actions "could be considered" to resume the works, as some "may continue individually" while others affect areas not covered by the license.

"It is a matter to be resolved," Villar maintained, emphasizing that the City Council will "respect" the judicial ruling while initiating processes to determine "how to proceed with its implementation."
